Terms of Use

1. Agreeing to these terms
These terms are an agreement between you and Stellar Dynamics ("ATLAS", "we"). By using the ATLAS website, map or reports, you agree to them. If you use ATLAS for a company, you agree for that company and confirm you may do so. If you don't agree, please don't use ATLAS.
2. Who may use ATLAS
You must be at least 18 years old and able to make a binding agreement. ATLAS is built for planning and business decisions and is not directed to children.
3. What ATLAS is
ATLAS is a planning aid. It gathers public records about a place (zoning, floodplain, environment, traffic, people and published fees), organizes them, and adds its own estimates, scores and screening tools so you can compare sites early.
4. Public records and estimates
ATLAS summarizes records published by others, for example the U.S. Census Bureau, FEMA, TCEQ, the U.S. Fish & Wildlife Service, USDA, TxDOT and city and county GIS offices. Those records can be incomplete, out of date or wrong at the source. Each answer says where it came from and when; anything ATLAS works out itself is labelled as an ATLAS estimate, and where nothing reliable exists ATLAS shows XX instead of guessing.
5. Not professional advice or services
ATLAS does not provide legal, engineering, surveying, zoning, environmental, appraisal, real estate, tax or financial advice or services, and nothing in ATLAS is a zoning determination, a survey, an appraisal, an engineering design or a bid. Using ATLAS does not create a professional or client relationship with us.
6. Verify before you rely on it
ATLAS is meant for early research and screening. Don't rely on it alone for an acquisition, lease, loan, construction, development, investment or other important decision. Before you commit, get the independent checks the property and deal call for: zoning verification from the city, a survey and title work, environmental and geotechnical studies, engineering, utility confirmation, an appraisal or market study, and professional advice.
7. Beta service, availability and accuracy
ATLAS is in public beta. Features, plans and prices may change or be removed, and parts of ATLAS may be slow, unavailable or wrong at times, for example when a public data source is down (ATLAS then labels any saved copy it uses with its date). We don't promise that ATLAS will be available without interruption or free of errors.
8. Plans, payments and refunds
During the beta every plan is free and no one is charged. You pick a plan when you create your account and can upgrade, switch or cancel (back to the free Consumer plan) at any time on your Account page; changes take effect at once. Before paid plans start, we will post the price, billing period, renewal, cancellation and refund terms for each plan and email you, and you will have to confirm before you are charged. Nothing in the beta commits you to a paid plan.
9. Accounts
You need an ATLAS account to use the map. Give us a real email address you control, keep your password private, and don't share your account or let others use it; one account is for one person. You are responsible for what happens under your account, so tell us through the Contact page if you think someone else has used it. You can delete your account at any time on the Account page. We may suspend or close an account that breaks these terms (section 17).
10. Your information and your work
What you type, draw, import or save in ATLAS (cost assumptions, drawings, saved analyses) stays yours. Today it is kept in your own browser, not on our servers, unless you choose to send it: for example by ticking the box to share your numbers or by sending us a message. You give us permission to use what you send that way to run and improve ATLAS, as described in the Privacy Policy. Don't upload anything you don't have the right to use.
11. What belongs to ATLAS
Public records belong to the public or to the agencies that publish them, and ATLAS claims no ownership of them. ATLAS's own work belongs to Stellar Dynamics: the software and source code, the interface and design, the ATLAS name and logo, the way records are selected, organized, combined and interpreted, the scores, estimates, models, methods and calculations, the reports and their layout, documentation and the underlying databases. We give you a limited, personal, non-exclusive, non-transferable right to use ATLAS under these terms; you don't receive any ownership of it. You may use reports you generate for your own projects and share them with people you work with, such as lenders, partners and consultants.
12. Third-party data and services
Some data and services in ATLAS come from others, including government agencies, OpenStreetMap, the FOSSGIS routing service and Google Street View. They are provided by those providers under their own terms, licenses and attribution requirements, and their accuracy and availability are outside our control. Map data © OpenStreetMap contributors, available under the Open Database License (ODbL). Other sources are named on each answer and described on the About page.
13. Acceptable use
Please don't: copy, scrape or bulk-download ATLAS or its reports with automated tools; resell or offer ATLAS or its outputs as your own service; copy, decompile or reverse engineer the software or its methods; get around plan limits or security measures; overload or disrupt ATLAS or the public services it relies on; use ATLAS to harass anyone or to look people up rather than places; or use it in a way that breaks the law or the rules of the data providers.
14. No warranties
To the fullest extent the law allows, ATLAS is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement.
15. Limitation of liability
To the fullest extent the law allows, Stellar Dynamics is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost deals or lost data, arising from your use of ATLAS. Our total liability for any claim related to ATLAS is limited to the amount you paid us for the plan or report that gave rise to the claim in the twelve months before it (zero during the free beta). Some places don't allow some of these limits, so they may not all apply to you.
16. Your responsibility to us
If someone brings a claim against Stellar Dynamics because you misused ATLAS or broke these terms, you agree to cover the reasonable costs of that claim, to the extent the law allows.
17. Suspending or ending access
We may suspend or end access for anyone who breaks these terms or puts ATLAS, its users or its data providers at risk. You may stop using ATLAS at any time. Sections 10 through 18 continue to apply after that.
18. Governing law and disputes
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Before filing any claim, please contact us so we can try to resolve it informally. Any dispute that isn't resolved that way will be handled in the state or federal courts located in Bexar County, Texas, unless the law where you live requires otherwise.
19. Changes to these terms
We may update these terms as ATLAS changes. We will post the new version here with its date, and for important changes we will tell you in ATLAS before they take effect. Using ATLAS after a change means you accept the new terms.
